Terms of Service
These Terms of Service ("Terms") govern your use of AI Estate Operator ("the Service"), provided by T.M.E The Marketing Experts Ltd ("TME", "we", "us"), registered in Cyprus (reg. no. HE 457797), registered office at 15 Kallipoleos, Amaral 30, 4th Floor, Office 402, 1055 Nicosia, Cyprus. By creating an account or using the Service, you ("the Agency", "you") agree to these Terms.
1. The Service
AI Estate Operator provides an AI assistant that replies to prospective clients on WhatsApp on your behalf, helps qualify them and book property viewings, and gives you a dashboard, CRM and calendar. The Service relies on the WhatsApp Business Cloud API and other third-party providers listed in our Privacy Policy.
2. Your account
- You must provide accurate information and keep your login credentials secure;
- You are responsible for all activity under your account and for your staff's use of it;
- You must be a business and legally able to enter into this agreement.
3. Your responsibilities and acceptable use
- You are the data controller for the people who contact you and must have a lawful basis and any required consent (including WhatsApp opt-in) to message them;
- You must comply with the WhatsApp Business Messaging Policy, Meta's Business Terms, and all applicable laws (including data-protection and consumer-protection law);
- You must not use the Service to send spam or unlawful, misleading, or harmful content, or to impersonate others;
- You are responsible for the accuracy of the listings, prices and information you provide to the assistant.
4. AI-generated content
The assistant uses AI to generate replies. While we work to keep it accurate and grounded in your data, AI can make mistakes. You are responsible for reviewing important interactions and for any commitments made to your clients. The Service is a tool to assist your business, not a substitute for professional judgement or legal, financial or property advice.
5. Fees and billing
Use of the Service is subject to the subscription plan and any usage-based charges (for example message credits) described at sign-up or in your order. Fees are billed in advance according to the plan you select, non-refundable except where required by law, and may change on reasonable notice.
6. Intellectual property
We own the Service and all related software and materials. You keep ownership of the data and content you put into the Service. You grant us the limited rights needed to operate the Service for you and to provide it to your clients on your behalf.
7. Data protection
Our handling of personal data is described in our Privacy Policy. Where we process personal data on your behalf, we do so as your processor under a data-processing agreement, which forms part of these Terms. We do not use your data to train AI models.
8. Availability
We aim to keep the Service available and reliable but do not guarantee uninterrupted operation. We may perform maintenance and may modify or improve features over time.
9. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" to the fullest extent permitted by law. To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or lost business, and our total liability under these Terms is limited to the fees you paid for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or the WhatsApp/Meta policies, or where required to protect the Service or others. On termination, we will delete or return your data in line with our Privacy Policy.
11. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, give you reasonable notice.
12. Governing law
These Terms are governed by the laws of the Republic of Cyprus, and the courts of Cyprus have exclusive jurisdiction, without prejudice to any mandatory consumer rights.
